When is a SWPPP required?

The Texas Commission on Environmental Quality (TCEQ) requires construction sites to have a Stormwater Pollution Prevention Plan (SWPPP) in place to contain contaminants. And, they take it very seriously – with possible fines of up to $32,500 per day, per violation. (🥴 ) So, if you’re wondering if you need an SWPPP for your project, the answer is likely “yes.”

The TCEQ’s Construction General Permit lays out the rules for the project checks.

You need a SWPPP if your project:

  • Disturbs one or more acres of soil (clearing, grading, excavating, etc.) – Or,
  • Is part of a larger, common plan of development that will disturb one or more acres.
